TEMPO.CO, Jakarta - Jakarta Deputy Governor Basuki 'Ahok' Tjahaja Purnama said former Jakarta Transportation Agency chief Udar Pristono would not receive legal assistance from the Legal Bureau since Udar was caught in a corruption case. "As far as I know, there is no legal assistance for corruption case," said Ahok yesterday.
The legal assistance is given to all civil servants caught in legal case, but those who become suspects in alleged corruption will not receive such assistance, Ahok added.
In this case, the prosecutor has named four suspects, two of them are former Jakarta Transportation Agency chief Udar Pristono and BPPT’s center of technology and transportation system director Prawoto. Both were named suspects on May 9, 2014.
The other two suspects were allegedly involved in setting the winner of auction. They are Drajat Adhyaksa, in his capacity as budget authority holder and Setyo Tuhu, former head of the bus procurement bidding committee.
Jakarta Employment Agency chief I Made Karmayoga said that Udar is still a civil servant until there is an 'inkracht decision', meaning it is final and binding. This also means Udar still receives 75 percent of basic salary.
Udar could receive legal assistance because there is no regulation from the Civilian State Personnel Law that regulates the technical implementation. In the law, legal assistance cannot be provided for employees caught in criminal case. "There’s no loophole to provide legal assistance in criminal case," said Made.
