TEMPO.CO, Jakarta - The Prosperity and Justice Party (PKS) plans to file a complaint against the Corruption Eradication Commission (KPK) to the National Police Headquarters today. First, PKS plans to charge the KPK with disconcerting acts related to the confiscation of Luthfi Hasan Ishaaq’s cars. Second, the KPK will be charged with trespassing by entering another person’s office by jumping over the gate.
PKS deputy secretary general, Fahri Hamzah said the PKS would bring a copy of the KPK’s confiscation procedure and include it in their report to the National Police. When the KPK came to confiscate the cars, Fahri said they did not have an official confiscation warrant and identity cards with no prior notification.
However, KPK officials failed to confiscate the cars. The KPK’s version of events stated that the investigators were obstructed by the office’s security. A number of people dressed in civil servant uniforms also prevented the officials from taking the cars. KPK deputy chairman, Bambang Widjojanto, said the investigation team already brought a warrant for confiscating the cars.
However, KPK deputy chairman Busyro Muqoddas said that in a state of emergency and urgency where the investigator must immediately act and cannot obtain a warrant beforehand, the investigator is allowed to confiscate moving objects. "This is included in KPK Law No. 30/ 2002," he said.
