Corby Clemency Could Be Annulled
TEMPO Interactive, Jakarta:Supreme Court Justice Gayus Lumbuun is of the view that the lawsuit filed with the State Administrative Court (PTUN) against the clemency for Australian drug convict Schapell Leigh Corby followed proper procedures. "The clemency granted on Corby could be annulled through the ruling of the State Administrative Court," said Gayus Thursday, May 31, 2012. "The President's authority [to grant clemency] is not absolute which cannot be rescinded," said Gayus Lumbuun. The presidential prerogative, he said, is an authority granted by law and it is not absolute in nature, meaning that it can be contested for annulment. Gayus explained that every decision made by the President could be wrong, and the people have the authority to question the decision. In the case of clemency for Corby, Gayus said the people can lodge a protest through the PTUN to ensure whether or not the clemency is right in terms of the clemency law. The PTUN judge will rule whether administratively the presidential power can be proceeded or annuled, Gayus said. RAFIKA AULIA
