Dahlan Suggests DPR to Seek Supreme Court Advice
TEMPO Interactive, Jakarta:State-Owned Enterprises (SOEs) Minister Dahlan Iskan has suggested the House of Representatives’ (DPR) SOEs Commission to request a legal opinion from the Supreme Court with regard to SOEs Minister Decree No. 236/MBU/2011 on the Delegation of Authority.
“No one can rule that the decree violated the law,” said Dahlan in an SOEs Ministry press release on Wednesday. Dahlan believes that his suggestion is the most equitable way to settle the polemic surrounding the decree.
Dahlan said that he does not understand the interpellation plan which some members of the DPR have discussed. In a meeting between the ministry and the SOEs Commission in March, Dahlan added, the common ground had been established to amend the ministerial decree. However, the deal was never realized. “All of us insisted that [the decree] did not violate the law.”
Some DPR members have used the interpellation rights against Dahlan to challenge the SOEs minister’s decision on the Delegation of Authority which has been considered to be a violation against Article 15 of Law No. 19/2003 on SOEs. Another reason for their objection is because the decree allows SOEs board of directors to sell assets without getting the approval first from the DPR, president, or Finance Minister.
