MD3 Law Applied, Refly Harun Suggests Jokowi Not Issue Perppu

TEMPO.CO, Jakarta - Constitutional Law expert Refly Harun suggests President Joko Widodo (Jokowi) not issue the regulation in lieu of law (Perppu) to annul the Law on the People`s Consultative Assembly (MPR), House of Representatives (DPR), and Regional Legislative Council (DPRD) or known as UU MD3 which has been ratified.
"I am one of those who disagrees with Perppu. We cannot easily bound by Perppu, even though the Constitutional Court opened the chance," said Refly when contacted on Wednesday, March 14.

Refly argued if the president often makes the Perppu, it will create executive tyranny on Jokowi administration. In addition, it must be approved by the House of Representatives and could not be taken as a mean to cancel UU MD3. "If the demand didn’t approve by DPR, the president might lose his dignity," Refly said.
However, if the DPR accepted the Perppu over UU MD3, it means the legislators had done many mistakes. The most likely way to break the law, he went on, is by filing a judicial review to the Constitutional Court. "But, it needs an objective judge because the previous one was doubtful," he added.
Meanwhile, President Jokowi previously claimed that he will not issue Perppu related to the MD3 Law. Jokowi waited for the material test result in the Constitutional Court. "The material should be tested first. Had the Perppu established, it should be approved by DPR," Jokowi asserted.
