Jokowi Passes Law Overseeing the Omnibus Method

TEMPO.CO, Jakarta - President Joko Widodo, or Jokowi, has officially ratified Law No.13/2022 overseeing the changes on Law No.12/2021 on legislation formation (UU PPP) on Thursday, June 16, which regulates the omnibus law legislation method.
A new Article was added to the rule that states; “The use of the omnibus method in formulating a legislation must be specified in the planning document.”
Meanwhile, Article 64 saw new paragraphs that state:
(1a) The preparation of the Draft Legislation as referred to in paragraph (1) may use the omnibus method.
(1b) The omnibus method as referred to in paragraph (1a) is a method of preparing laws and regulations by:
- Including new materials;
- changing the content that has relevance and/or legal requirements regulated in various laws and regulations of the same type and hierarchy; and/or
- revoke laws and regulations of the same type and hierarchy, by combining them into one legislation to achieve certain goals.
Members of the House of Representatives (DPR) recently agreed on the ratification of the RUU PPP during a session at the Senayan Parliamentary Building on May 24, 2022, which follows the verdict issued by the Constitutional Court (MK) that annulled the Job Creation Act (UU Cipta Kerja) because the omnibus method was not regulated in Indonesia’s law-making system.
